Fantazom Terms and Conditions

PLEASE READ THE FOLLOWING CAREFULLY . This agreement (the "Agreement") is a binding agreement between the individual or the entity identified in your Fantazom account ("you" or “author” or “storyteller” "Publisher") and the Fantazom parties. The "Fantazom parties" are, individually, Fantazom Inc, Fantazom.com, and the Fantazom IOS and Fantazom Android Apps. "Fantazom," "we" or "us" means, together, the Fantazom parties. By using the service You agree to the terms governing the applications, features, and functionality available on or through Fantazom. If you do not agree with the terms contained in this Terms of Service, do not use the service.

This Agreement provides the terms and conditions of your participation in the Fantazom Digital Books self-publication and distribution program (the "Program") and your publication and distribution of digital content through Fantazom (all such content, "Digital Books") consists of the terms set forth below.

These Terms and conditions are subject to change and updates will be sent to the email you provide.

About Fantazom - Fantazom operates a digital ebook distribution platform. We make it simple, free, fast and easy for authors, publishers, and agents to publish and distribute ebooks. Although Fantazom provides authors, publishers and agents a platform to publish and distribute ebooks, Fantazom itself is not a publisher, and therefore does not and cannot assume the legal rights, responsibilities or liabilities of a publisher outside of a specific agreement to do so.

Account Information; No Multiple Accounts . You must ensure that all information you provide in connection with establishing your Fantazom account, such as your name, address and email, is accurate when you provided it, and you must keep it up to date as long as you use Fantazom. You may maintain only one Fantazom account at a time and within that account you may use more than one author name [Pen-Name]. If we terminate your account, you will not establish a new account. You will not use false identities or impersonate any other person or use a username or password you are not authorized to use. You authorize us, directly or through third parties, to make any inquiries we consider appropriate to verify account information you provide. You also consent to us sending you emails relating to the Program and other publishing opportunities from time to time.

Optional Programs and Services. We may make available to you optional programs and services through Fantazom. Terms and conditions for those optional programs and services will be included in updates of this Agreement.

Rights and Obligations of Authors, Publishers and Agents - If you upload (publish) a work to Fantazom, you understand and warrant that you are the legal publisher of this work; you control all rights and assume all liabilities associated with the publication of this work; and you warrant and affirm that no aspect of your work infringes or violates the rights of another person, party or entity. In your role as the author, publisher or agent, you understand you are the publisher of your work, and therefore you or your author are responsible for the writing, editing, formatting and cover design for your book. As the authorized author, rights owner, publisher or agent, you are responsible for uploading your book to Fantazom.

The following describes how users (“End Users”, “Readers”) of the Site who read ad-supported books for free or purchase downloadable ad-free digital books (“End Users”, “Readers”) can download material and how they may read that work by the person or entity who posted the work (the “Author” or “Publisher”). For the sake of simplicity, this Terms of Service may use the terms Author, storyteller and Publisher interchangeably. The term “Agent” refers to the Author’s duly authorized representative, who is only authorized and empowered to collect and receive directly the monies payable to the agent as described in our Royalties and Payments section.

The following also describes the rights and responsibilities of the Author and Fantazom. Any user of this Site who downloads reads any Work on the Site is referred to as an “End User” or “reader”.

The Grant and the Territory
The Author hereby grants and assigns to Fantazom the non-exclusive worldwide right to digitally publish, distribute, market and sell (“Publish”), the work identified on the front page of your submission (the “Work”). Since the terms of the agreement with Fantazom, herein, is non-exclusive, the Author or Publisher is free to Publish, license, market and sell their work elsewhere so long as the Author or Publisher is not violating someone else’s agreement or violating any laws.

Distribution. Fantazom will generally distribute any such submissions which do not violate, or which do not appear to violate the Agreement.

Distribution of Work As Is. Generally, Fantazom will Distribute Author’s Work as it is delivered to us, and not edit or modify the Work. Certain modifications may occur caused by file or design conversions. Fantazom does not guarantee the accurate preservation of the original Work’s formatting.

Distribution at Option of Fantazom . Fantazom may decide not to distribute Author’s work or may decide to discontinue its publication of Author’s work for any reason, and no reason need be provided. Except in the cases of gross violations of this Terms of Service, Fantazom will make every attempt to provide reasonable notice to the Author via email, up to and including providing instructions on how to remedy potential issues that might prevent Fantazom from listing a title.

How to "Unpublish" Works from Fantazom. Fantazom may distribute the Work until Author/owner of the Work decides to unpublish the work (to unpublish, log in to the system, click on “My Stories” and then delete the work in question) If author is unable to access the site, the author may notify Fantazom in writing to remove the Work by emailing feedback@fantazom.com . After that notice is acknowledged to you by a reply email from Fantazom, Fantazom will remove the work from Fantazom.com within ten business days. To ensure your book is properly and quickly removed, go to your “My Stories” and delete it.

Infringement.

Removal of Infringing or Defamatory Work of Author . Fantazom takes claims of infringement seriously and may take immediate action upon notice from someone claiming to be an Infringed party. Generally, upon receipt of a written notice from a party infringed or defamed by Author’s material (or someone purporting to be his agent, publisher, attorney in fact or assign), Fantazom will remove the Author’s Work and reserves the right to remove any and all information about the Author, the Author’s Work or the publisher from the Site.

Infringement by Others Upon Author’s Work. If an Author or copyright holder learns that a third party is violating Author’s copyright or pirating or illegally distributing a Fantazom-published work, the Author shall inform Fantazom; however, it is the Author’s responsibility to seek relief from the offending parties. If that violated work is published on Fantazom, Fantazom will remove it per section 3a above.

Copyright . The copyright in the Work shall belong to the Author or the party that Author cites as the copyright holder. The author shall be solely responsible for filing its copyrights and any other intellectual property with the appropriate governmental body. It is the Author’s responsibility to place a copyright notice on the copyright page or some other prominent place in the Work.

Formats of Digital Conversions. The author shall, at their own expense submit their Work as an epub file.

Pricing. The list price for selling your book without ads is predetermined, fixed and not optional. Readers can enjoy your book for free for as long as they like, and as they do so, you earn royalties. If a reader decides they like your book and want to proceed without ads, they can purchase your book on Fantazom at any time. You are free to list your book on any other site you choose at any price you choose. We do not recommend selling it for a lower price elsewhere, however you are free to do so.

Currency Conversion. We may eventually sell your Book using multiple currencies. When we do, we may convert the List Price to other currencies (each, a "Sale Currency") at an exchange rate we determine. We may periodically update the converted List Price in order to reflect current exchange rates. For purposes of royalty calculations, the converted List Price in the Sale Currency will be your List Price when we offer and sell your Book in the Sale Currency.

Royalties and Payments . If you are not in breach of your obligations under this Agreement, for each Book read with ads or sold to a customer through the Program, Fantazom will pay you the applicable Royalty set forth in our pricing guidelines.

When We Pay You. Unless otherwise specified in the Royalties Payment Section , Fantazom will pay Royalties due on digital book reads with advertising, and digital ad-free book sales on a quarterly basis. These payments require a ten-dollar minimum and will be paid to you via direct deposit to the bank account information you provide. If you do not provide the bank account information, you will not be paid. The payments will be made on or before the fifteenth of the month following the end of quarter. For example, quarterly earnings will be paid out on or before the month following the months of March, June, September and December with a ten-dollar minimum. If at the end of the current quarter you have not earned at least ten-dollars, we will roll your current earnings to the following quarters until you reach the ten-dollar threshold. At any time, you are able to view your current earnings through a report in your account.

Payment Currencies. At this time, payments can only be made in United States Currency and as a direct deposit to the bank account information you provide. If you do not provide the bank account information, you will not be paid. When alternative currencies are made available through Fantazom, we will notify you through email updates to these terms and conditions.

Payment Terms for Non-U.S. Publishers. If you are a publisher located in outside of the U.S.A., you must provide us with a U.S. Bank Account. Upon providing us with that bank account information, we will pay you Royalties from ad-free sales and ad-supported reads of your books.

Payment Policies. We require you to provide certain information or to register a valid U.S. bank account in your Fantazom account in order to receive Royalty payments, in which case we will not be obligated to make Royalty payments to you unless you do so. We may establish other payment policies from time to time, such as different minimum payment amounts for different payment methods and check fees.

Payment Disputes. You may not bring a suit or other legal proceeding against us with regard to any statement unless you bring it within six months of the date of the original dispute. Any such proceeding will be limited to a determination of the amount of monies, if any, payable by us to you for the accounting periods in question, and your sole remedy will be the recovery of those monies with no interest.

Offsets, refunds, etc. We can withhold Royalties and offset them against future payments as indicated below. Our exercise of these rights does not limit other rights we may have to withhold or offset Royalties or exercise other remedies.

a. With every book on Fantazom available for free through ad-supported books, a reader is free to read as much of a digital book as they’d like, for free, before purchase, therefore, we do not offer refunds on the purchase of digital books.

b. If a third party asserts that you did not have all rights required to make one of your Books available through the Program, we may hold all Royalties due to you until we reasonably determine the validity of the third party claim. If we determine that you did not have all of those rights or that you have otherwise breached your representations and warranties or our Declared Content Guidelines with regard to a Book, we will not owe you Royalties for that Book and we may offset any of those Royalties that were previously paid against future Royalties, or require you to remit them to us.
• Upon termination of this Agreement, we may withhold all Royalties due for a period of three months from the date they would otherwise be payable in order to ensure our ability to off-set any offsets we are entitled to take against the Royalties.

c. If we terminate this Agreement because you have breached your representations and warranties or our Declared Content Guidelines, you forfeit all Royalties not yet paid to you. If after we have terminated your account you open a new account without our express permission, we will not owe you any Royalties through the new account.

Taxes. Fantazom is responsible for collecting and paying any and all taxes imposed on their respective sales of Books to customers. You are responsible for any income or other taxes due and payable resulting from payments to you by Fantazom under this Agreement. Accordingly, unless otherwise stated, the amounts due to you are inclusive of any taxes that may apply to such payments. Fantazom maintains the right, however, to deduct or withhold any and all applicable taxes from amounts due by them to you, and the amounts due, as reduced by those deductions or withholdings, will constitute full payment and settlement to you as described in our Royalties Payment Section .

Free reading . Readers read your content for free when they choose to read ad-supported version of your books and you receive payments as described in our Royalties Payment Section .

Promotional Rights and advertising your book. Fantazom shall have the right to distribute advertising samples of the Work in any form of media within the Fantazom service. These advertising samples will be either system generated or you may create your own. These ads will be placed in other books on Fantazom at no cost to the author and with no revenue generated for anyone.

Crawlable or Other Searchable Rights. Fantazom shall have the right to drive traffic to the Author’s Work on the Fantazom Site through (a) general Search Engine Optimization services (b) crawlable, promotional hypertext links or (c) arrangements with third parties.

Account security: As an author, publisher or agent, you are responsible for controlling access to your Fantazom account. When you sign up for a Fantazom account, you will provide Fantazom an email address and a password as your login credentials. By publishing with Fantazom, you acknowledge your responsibility to choose a secure email/password combination, and it is your responsibility to keep this email/password combination private and secure and to update your password as needed to maintain account security. Fantazom cannot be held responsible if authors use insecure email/password combinations that allow cybercriminals to log into their account. Financial information is not stored on any Fantazom server, but kept secure on a third party high security platform.

Author and Publisher Warranties . The warranties and representations contained in this Agreement extend to the Author and its licensees and successors and assigns. By uploading content to Fantazom, you agree that any violation of the warranties below may result in immediate closure of your account and the forfeiture of accrued earnings.

a. You further warrant that the Work contains no materials which:
• violate any right of privacy which is libelous or violate any personal right or other right of any kind of any person or entity (this includes publishing a person's private email address without their permission);
• would violate any of Your contracts or would disclose any information given to You on the understanding that it would not be published or disclosed;
• plagiarize or pirate any other work or infringe upon any copyright, trademark or other proprietary right;
• are injurious to End-Users or others including but not limited to recipes, formula or instructions
• are defamatory to any person or entity
• violate the publicity rights of another person or entity
• violate state and federal laws.
• advocates hateful, violent, criminal, discriminatory or racist views or actions toward others
• advocates or condones violence against another person, whether or not the other party is a willing participant
• advocate illegal activities
• advocates the use of Private Label Rights (PLR) content to make money on the Internet, or the modification of such content for the creation of Internet content
• Fine art books of a non-erotic nature that contain nudity may be accepted on a case by case basis at the sole discretion of Fantazom
• contain hyperlinks to third party marketing pages, especially if the ebook is published for the sole intent of publishing hyperlinked content that directs readers to third party marketing pages
• contains incomplete information and prompts the reader to access external resources or services that require registration or payment
• is an incomplete book for the purpose of promoting the purchase of the complete book elsewhere or on Fantazom. Books priced at FREE are held to this same standard.
• makes false, misleading or inaccurate claims or promises in the book or book description

b. You further warrant the book meets the following standards for originality:
• this is not a public domain work;
• the book does not include word-for-word copy and paste segments - or is not a compilation - from Wikipedia or other public domain, government or commercial services;

c. You further warrant the book represents a complete work:
• this is not an unfinished, work-in-progress;
• the uploaded file is not a partial sample or sample chapter, or is not a collection of sample chapters, or not simply a catalog advertising other books or products
• the work is complete and self-contained, and does not try to upsell the user to purchase, or register for, access to information that should have been contained in the book;
• the title meets the definition of "book" or "story." Short incomplete ramblings or works that read more like brochures than books are not allowed.
• the uploaded book represents a complete story with a beginning, middle and end. Exception: Serials are allowed. Each serial cover image should be different, even if the only difference is a notation on the cover image about the serial's position or episode number in the series. To avoid customer confusion, we recommend it should be clearly identified as a serial in the book description and the serial episodes should be linked together and noted during the book upload.

Book Rejection . We are entitled to determine what content we accept and distribute through the Program in our sole discretion. If we request that you provide additional information relating to your Books, such as information confirming that you have all rights required to permit our distribution of the Books, you will promptly provide the information requested, and you represent and warrant that any information and documentation you provide to us in response to such a request will be current, complete, and accurate. You authorize us, directly or through third parties, to make any inquiries we consider appropriate to verify your rights to permit our distribution of the Books and the accuracy of the information or documentation you provide to us with respect to those rights.

Accuracy of Payment Settings page information
When you establish your account at Fantazom, you will complete Payment Settings information to satisfy IRS-mandated tax compliance requirements.

a. You acknowledge it is your responsibility to keep your Payments Settings updated with accurate information.

b. You acknowledge that incorrect information may prevent or delay royalty payments.

c. You acknowledge it is strictly prohibited to knowingly enter false information when certifying your tax status. Deliberate attempts to subvert IRS rules and regulations - by entering false information to gain preferential tax treaty status or reduced tax withholdings - may lead to immediate account closure and forfeiture of earnings.

End Users . “End-Users” include authors, publishers, advertisers, agents and readers. Readers are those who read ad-supported books for free or purchase and download digital books without ads. Readers are allowed to use each copy of the Work for their personal enjoyment in any reasonable non-commercial manner in compliance with copyright law and pursuant to this Agreement.

Through ad-supported books, Fantazom readers can read, for free, any book published on the site. You can find new and experienced authors in a varied genres and read their work for free. Cookies are stored in your browser to allow you to be automatically logged in to Fantazom when you arrive - if you have not manually logged out after your previous visit.

To become an end user or reader at Fantazom we need only limited information that we do not share in any way with anyone. Registration requires only your name, your birth-year, gender, a valid email address and the zip code in which you live. This information is used to provide appropriate content to minors, to give you the most relevant content and to contact you about your account. We WILL NOT fill your inbox with spam and you can opt out of Fantazom emails that are designed to lead you to great books to read for FREE.

During registration you will be given the opportunity to provide us with limited details about what you’d like to read and your personal interests. Again, we will not share this information with anyone; it will only be used to provide you with the most relevant content. You may refuse to provide this and you may change your preferences at any time.

You will be asked to create a Fantazom password to provide secure access to your account.

Fantazom keeps track of various details of your time on the site including the blurbs, book-jacket summaries and books you read. We use that information in our search system. We will never use or share your name or any other information with an author. Our authors will never know your name or contact information and will not be able to directly contact you.

At Fantazom we allow authors to publish under assumed or pen names. In these cases, we do not reveal the identity of the author to anyone.

Authors who publish on Fantazom maintain ownership of their work until the time they choose to sell those rights. At registration, authors are required to provide a higher level of information for the purposes of communication and proper payment. We do not sell or share this information with anyone.

Rights of Use.
1. Purchased works: As an End User, you acknowledge that all Work furnished by Fantazom are licensed for the use of the End Users of the Site and may not be sublicensed or resold. If you purchase a work, you hold a non-exclusive, non-transferable, and non-distributable right of use. In other words, you are free to enjoy it for your own use, but you are not authorized to share, sell, or distribute the work to others.

2. Free ad-supported works: Free ad-supported works published at Fantazom are the copyrighted material of the author or publisher, and therefore are not authorized for redistribution without prior written consent from Fantazom. Third parties are not authorized to download, host and otherwise redistribute any free ad-supported or purchased Fantazom books without prior written agreement from Fantazom. Directory services and third party marketers may reproduce the metadata information found on each book's book page (cover image, book description, price, etc.) provided hyperlinks to direct visitors to the Fantazom home page, and provided users are not charged for access to these listings. New visitors are required to create an account to gain access to Fantazom books.

Fees and Services. By using Fantazom, the reader who chooses to purchase any ad-free digital ebook customer is agreeing to pay the fees as presented by Fantazom at the time of purchase. All purchases are final and non-refundable. The Site may change pricing policies and fees for services we provide at any time from time to time and changes shall be effective immediately. Unless otherwise stated, all fees are quoted in U.S. Dollars. The reader is responsible for paying all fees and applicable taxes associated with your use of the Site.

Author, Publisher and Customer Conduct. Fantazom and its users work together to keep the Site working properly. Please report problems and policy violations to Fantazom by clicking the ‘got suggestions’ link at the bottom of the Fantazom home page. The warranties and representations contained in this Agreement also extend to End Users of Fantazom. While using the Site, Services or Work, End Users agree to not:

a. violate any laws, third party rights, or any policies which we have posted on the Site from time to time;

b. upload any material which violates this Terms of Service; use the Site to publish, Service or Work if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Site;

c. circumvent or manipulate our fee structure or the billing process;

d. use robots, spiders, or other methods in an attempt to unfairly cheat the site's ranking systems for free ad-supported reads, downloads, and sales, or hire others to do the same

e. engage in spam, advertising, marketing, chain letters, pyramid schemes or money laundering involving or using the work distributed on Fantazom;

f. distribute malware, viruses, or any other technologies that may harm Fantazom or the interests or property of Fantazom users;

g. modify, copy, or distribute content from the Fantazom site or Fantazom copyrights and trademarks;

h. engage in abusive or profane behavior toward Fantazom, its employees, its authors, advertisers or fellow users

i. threaten Fantazom or Fantazom retail partners with legal action due to inaccurate book listings or failure to remove books in a timely manner

j. Without limiting other remedies, we may limit, suspend, or terminate author, reader, agent, advertiser accounts, revoke earnings, prohibit access to Fantazom, demand return or destruction of any work improperly used or taken from Fantazom. We may take legal and technical steps to keep certain users off Fantazom if we think that they are creating problems or legal liabilities, or acting inconsistently with the spirit or the letter of our policies.

Ownership. You acknowledge and agree that the Fantazom Site, Apps and Service are proprietary to Fantazom and that the Work is proprietary to the Author or copyright owner; that none are proprietary to reader or end user.

Termination. Either party may terminate this Agreement at any time without notice. Registered Fantazom users may cancel their account at any time, and published Fantazom authors may unpublish their book listings at any time. However, purchased books will not be removed from customers' accounts, either at Fantazom or at Fantazom apps. When an author or publisher unpublishes a book at Fantazom, the distribution of that book stops immediately.

Indemnification.

General . You (Author, Publisher, advertiser, reader or End User) agree to indemnify and hold Fantazom and its licensees, successors and assigns, and its and their distributors, customers, officers, directors, members, employees and agents, harmless against any expense (including, but not limited to, reasonable attorneys’ fees and disbursements) or judgment, settlement or other liability arising out of any claim or legal proceeding asserting claims contrary to any warranty or representation made by You in this Agreement.

Paid Advertising.

By paying to advertising on Fantazom, you agree to the following general principles as well as any other terms and conditions agreed to in your specific advertising plan:

a. You will provide, at your own expense the advertising media as required by Fantazom and described in your specific advertising plan.

b. You allow Fantazom to place your ads in any/very book, solely at the discretion of Fantazom and based on your campaign targets.

Notice of Claim. Upon receiving notice of any claim, demand, action or suit or other legal proceeding alleging facts inconsistent with or contrary to any of the warranties or representations contained herein, Fantazom shall have the right to withhold any sums payable to the Author in reasonable amounts as security for the payment of the Author’s potential obligations pursuant to the indemnity contained in these terms and conditions. It is intended that the right granted by these terms and conditions shall not be unreasonably or frivolously exercised by Fantazom.

Disclaimer of Publisher’s Warranties.

WARRANTY DISCLAIMER . All Works and the Service are provided to End Users “AS IS” and “WITH ALL FAULTS.” THE ENTIRE RISK AS TO THE SELECTION AND USE OF THE FANTAZOM SERVICE OR ANY MODIFICATIONS THERETO OR THE WORK IS WITH AUTHOR AND END-USERS. FANTAZOM DOES NOT WARRANT THAT THE PRODUCT OR MODIFICATIONS WILL MEET THE REQUIREMENTS OF END-USERS. TO THE EXTENT THAT FANTAZOM MAY NOT, AS A MATTER OF APPLICABLE LAW, DISCLAIM ANY WARRANTY, THE SCOPE, AND DURATION OF SUCH WARRANTY SHALL BE THE MINIMUM PERMITTED UNDER APPLICABLE LAW.

MISCELLANEOUS.

Entire Agreement . This Agreement is the entire agreement between the parties concerning the subject matter hereof.

Governing Law; Severability. This Agreement shall be governed by and construed in accordance with the substantive laws of the State of Georgia. If any portion of this Agreement is held invalid, the parties agree that such invalidity shall not affect the validity of the remaining portions of this Agreement.

No Agency. No agency, partnership, joint venture or other joint relationship is created hereby.

Legal Action. the venue for all purposes hereunder shall be in Whitfield County, Georgia, and the parties hereto hereby consent to such jurisdiction and venue. If any action or other legal proceeding relating to this Agreement or the enforcement of any provision of this Agreement is brought against any party hereto, the prevailing party shall be entitled to recover reasonable attorneys’ fees, costs, and disbursements (in addition to any other relief to which the prevailing party may be entitled).

Acknowledgement. By using the Fantazom you acknowledge that you have read this Agreement, understand it and will be bound by its terms and conditions.

IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the date and the year upon which the Author first approved such Terms of Service.

Digital Millennium Copyright Act (DMCA) Notice Policy

Fantazom is a distributor and unless otherwise specified, does not own the works uploaded to Fantazom. When authors, agents or publishers upload material to Fantazom, they certify to Fantazom their agreement to this Terms of Service, in which they certify they are legally permitted to upload such works. Allegations of copyright violations against authors, agents and publishers are extremely rare. Nevertheless, Fantazom maintains a zero-tolerance policy regarding copyright infringement and we welcome infringed parties to notify us if they believe their material is being distributed by Fantazom.

If you feel that content posted on the Fantazom Site infringes on your copyright(s), please immediately contact the Fantazom support team by clicking the "got questions" link at the bottom of the Fantazom home page.

If Fantazom takes action in response to an infringement notice, it will make a good faith attempt to contact the party that made such content available by means of the most recent known email address.

infringement notices should include; (1) An electronic signature and full name, address, phone number and email address of the copyright owner and the person authorized to act on their behalf; (2) An identification of the copyright claimed to have been infringed; (3) the location and nature of the content that Infringed party claims to have infringed upon its copyright, in sufficient detail to permit Fantazom to identify that content, such as a direct hyperlink to the infringing book listed at Fantazom; (4) hyperlinks, if available, to the original author's (the infringed party) work to help Fantazom investigate and support your case; (5) and a statement by the Infringed: (a) that you believe in good faith that the use of the content that you claim to infringe your copyright is not authorized by law, or by the copyright owner or such owner’s agent; (b) under penalty of perjury, that all of the information contained in your Infringement Notice is accurate, and (c) a statement that you are either the copyright owner or a person authorized to act on their behalf.

Upon receipt of a written notice from a party infringed or defamed by Author’s material (or someone purporting to be his agent, publisher, attorney in fact or assign), Fantazom may remove the Author’s Work and reserves the right to remove any and all information about the Author, the Author’s Work or the Publisher from the Site. Fantazom may allow corrected or legally vetted versions of the purportedly infringing or defamatory Work to be posted again, (1) with a stipulation between the parties that they have resolved their dispute, (2) a court order or (3) a certification by an independent attorney in whose professional opinion states that in the current version, the infringing material of which the purported infringed party has complained has been removed from the Work.

Agreement Acceptance. You accept this Agreement and agree to be bound by its terms by either (a) clicking agree or accept where you're given the option to do so or (b) by using the Program, or any part of it. If you don't accept the terms, you are not entitled to use the Program. If the Publisher is an entity, the individual person who accepts this Agreement for the Publisher represents and warrants that he or she is entitled to enter this Agreement as an authorized representative of Publisher and to bind Publisher to the terms of this Agreement.

Agreement Amendment . The Program will change over time and the terms of this Agreement will need to change over time as well. We reserve the right to change the terms of this Agreement at any time in our sole discretion. We will give you notice of the changes by posting new terms in place of the old at www.fantazom.com with a revision date indicated at the top or by sending an email to the email address then registered for your Program account. You are responsible for checking for updates and your continued use of the Program after we post changes will constitute your acceptance of the changes. If you do not agree to the changes, you must withdraw your Books from further publication or distribution through the Program and terminate your use of the Program.

Declared Content

Fantazom is dedicated to the privacy and safety of everyone on our site. Authors are free to publish children’s books as well as books with adult content. All authors are required to age appropriately categorize every book and to provide more detailed information called Declared Content to help readers find the most relevant content. Declared Content allows storytellers to declare specific content that readers may choose to enjoy, or avoid. Readers are also given the ability to flag inappropriate content, which will trigger Fantazom to review the book and respond accordingly. If you, the author or the copyright owner, have properly declared the content of your book, it will not be flagged for that content.

At Fantazom, we encourage Children to become readers and we help them find the right books to read. We also encourage parents to participate in the registration of their child and Fantazom can help track the progress of student-reading programs for teachers.

When anyone joins Fantazom we require a birth year and as always, Fantazom will not use the information for any purpose other than providing appropriate content. Fantazom has no system that allows a child or anyone else to provide contact information that could be used by anyone to contact the reader directly.

Special guidelines for erotic and other mature audience literature:
Fantazom allows a wide range of erotic and mature audience literature for readers who enjoy it. Like all publishers at Fantazom, erotic and mature audience literature authors and publishers are held to all the Declared Content requirements Fantazom Terms of Service. To benefit of our these authors, publishers and readers, we've created this special breakout section in the Terms of Service to provide guidance specific to erotic and mature audience literature. There are many gray areas when it comes to mature audience content, so we make no attempt to define erotic in a black and white policy. In an effort to provide the highest level of transparency, we provide a specific age group for the author to select during the book upload that will limit the book to those 18 and over. Thank you for your support as we work to preserve the greatest level of publishing freedom for our professional erotic and mature audience writers and publishers.

• Neither the book cover nor the book content of erotic and mature audience content may contain images of graphic nudity or graphic violence (either photographic or illustrated) or persons involved in acts such as these.
• Erotica and mature audience authors and publishers must categorize their books as such and select the box that restricts the book to an audience over 18. If an author or publisher miscategorizes erotic or mature audience content under non-erotic or mature audience categories, they risk either removal of the work or account termination, at the discretion of Fantazom.
• Authors who publish content categorized as “Restricted 18+” are required to provide Declared Content during the book upload. Authors and publishers who fail to provide this information, or miscategorize their works in an effort to subvert this effort to protect minors from inappropriate content, may face book removal and/or account termination at the sole discretion of Fantazom.
• Even with these protections in place, we recommend that book descriptions and titles for erotic and mature audience literature should be kept "PG-13". Excessively profane book descriptions may lead to reader complaints and or blocked distribution or removal from Fantazom.
• Fantazom has a zero-tolerance policy for erotica or mature audience with characters under age 16. Underage erotica and mature audience behavior is strictly forbidden, and the upload of such may lead to immediate book removal. In any literature that you publish on Fantazom, children cannot be engaged in, witness or consider sexual acts or situations. Stories with this type of content may be removed without notification at the sole discretion of Fantazom.
•Stories with Rape, sexual slavery, sexual violence, must be appropriately marked in the Declared Content of the Book Upload and may be subject to additional review and may be removed at the sole discretion of Fantazom.
• Bestiality may be allowed but must be appropriately marked in the Declared Content of the Book Upload, must be categorized as “Restricted 18+”, and may be subject to additional review and may be removed at the sole discretion of Fantazom.
• Incest and pseudo-incest (sexual relations among non-biologically related relatives and siblings) is allowed, but must appropriately marked in the Declared Content and must be categorized as “Restricted 18+”,during the Book Upload and may be subject to additional review and may be removed at the sole discretion of Fantazom.

Publishing on Fantazom never requires a payment. You can publish with zero investment, and still receive royalties for your work as shown below.

Zero Investment: You receive 35% of all proceeds of your story, whether advertising or sales.

Bronze: Two to nine shares at the current share value for future profit sharing and it raises your earnings to 36.5% of all proceeds of your stories.

Silver: Ten to nineteen shares at the current share value for future profit sharing and it raises your earnings to 38% of all proceeds of your stories.

Gold: Twenty to forty-nine shares at the current share value for future profit sharing and it raises your earnings to 40% of all proceeds of your stories .

Platinum: Fifty or more shares at the current share value for future profit sharing and it raises your earnings to 45% of all proceeds of your stories.

The current share value is: $2.50 and may be adjusted at any time without notice

You can help grow your investment by recruiting readers, storytellers and advertisers but there is no pyramid here, your investment in Fantazom is strictly used to propel us to become the world’s leading provider of multimedia on-demand entertainment created by aspiring storytellers. As Fantazom grows, so do your earnings.

In addition to increasing your earnings from your own stories, your investment gives you profit sharing from the entire company. As in any young company, Fantazom expects it to take several years to achieve profitability and our leadership team is committed to development and growth to reach our vision. Spam Policy and Enforcement

Fantazom authors are prohibited from promoting links to their Fantazom works via spam email (sure signs of spam: false "senders" or "reply to" addresses, inoperable or nonexistent unsubscribe/remove options, multiple receipts of the same email, text designed to confuse spam filters, and misleading subject lines). Fantazom authors who are found to be spamming risk termination of their account, removal of their works and forfeiture of accrued earnings. If you believe you have been the recipient of a spam email from a Fantazom author, please forward the entire email message, with full headers included, to feedback@fantazom.com.

Fantazom Email Policy

Fantazom does not engage in spam, nor does it share, rent or sell the personal contact information of its members with third parties or authors who publish on Fantazom.

As part of the signup process for Fantazom, you must give Fantazom permission to contact you via email. This is necessary for us to perform our service for you. For example, if you purchase an ebook, we may need to email you a receipt and download links. If you publish a book, we need to inform you of your book's status, of new marketing opportunities and notify you of your payment status.

Fantazom is committed to honoring your trust, your time and your interests by limiting the frequency of communications, ensuring that communications are relevant to interests you expressed, and ensuring you always have the ability to opt out of communications.

Fantazom sends various email communications to authors and publishers who publish books and to customers who use Fantazom. These emails may include purchase confirmations; review opportunities; occasional service updates; contest notifications, merchandising and promotional opportunities for authors, and Fantazom Alerts which provide readers opt-in notification of new book releases from their favorite authors; or other forms of email communications. Fantazom may introduce new categories of alerts or discontinue prior alert categories without advance notice.

In all cases, Fantazom will work to honor the time and interests of our end users.
